This Terms & Conditions is a legal agreement between you and Buried Cake Games ("we", "our", and/or "us"). This agreement governs your acquisition and use of our application software ("app"), whether downloaded directly from us or through a third-party platform such as Google Play or itch.io. This agreement provides a license to use the Buried Cake Games app and contains warranty information and liability disclaimers. These terms also apply to any Buried Cake Games updates, supplements, Internet-based services, and support services for the app, unless other terms accompany those items on delivery. If so, those terms apply.
The Buried Cake Games app is licensed, not sold. By downloading or using our app, these terms – as well as the privacy policy located at https://buriedcake.games/privacy-policy/ – will automatically apply to you. You should make sure therefore that you read them carefully before using the app.
If you do not agree with these terms and conditions, do not install or use the app. Nothing in these terms affects any statutory rights you may have as a consumer under applicable Finnish or EU law.
Buried Cake Games hereby grants you a personal, non-transferable, non-exclusive licence to use the Buried Cake Games app on your devices in accordance with the terms of this agreement.
You are permitted to load the Buried Cake Games app (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the app.
You are not permitted to:
Buried Cake Games shall at all times retain ownership of the app as originally downloaded by you and all subsequent downloads of the app by you. The app (and the trademarks, copyright, database rights and other intellectual property rights of whatever nature in the app, including any modifications made thereto) are and shall remain the property of Buried Cake Games.
Buried Cake Games reserves the right to grant licences to use the app to third parties.
Buried Cake Games is committed to ensuring that the app is as useful and enjoyable as possible. We reserve the right to make changes to the app at any time and for any reason. If we ever introduce paid features or services, we will make the pricing clearly known to you before any charge is made.
We recommend that you do not jailbreak or root your device. Doing so removes security restrictions imposed by the official operating system and may make your device vulnerable to malware or other security issues, and may cause the app to function incorrectly or not at all. We cannot be held responsible for issues arising from the use of the app on a jailbroken or rooted device.
You should be aware that there are certain things that Buried Cake Games will not take responsibility for. Certain functions of the app might require an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Buried Cake Games cannot take responsibility for the app not working at full functionality if you don't have access to Wi-Fi and you don't have any of your data allowance left.
If you're using the app outside of an area with Wi-Fi, you should remember that your agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for data used while accessing the app, or other third party charges. In using the app, you're accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory without turning off data roaming.
Buried Cake Games cannot take responsibility for the way you use the app. You need to make sure that your device stays charged, and if it runs out of battery and you can't use the app, Buried Cake Games cannot accept responsibility.
Although we endeavour to keep the app updated and functioning correctly, we do rely on third parties to provide certain information and services. Buried Cake Games accepts no liability for any loss, direct or indirect, you experience as a result of relying on third-party functionality within the app.
We may release updates to the app from time to time. Depending on the platform you use, updates may be applied automatically or may require your action. We do not guarantee that we will always update the app or that it will remain compatible with your device or operating system. We reserve the right to discontinue the app at any time. If the app is discontinued, the rights and licences granted to you under these terms will end and you should remove the app from your device.
To the maximum extent permitted by applicable law, Buried Cake Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of enjoyment, or loss of profits, arising out of or in connection with your use of or inability to use the app.
Nothing in these terms limits or excludes our liability for matters that cannot be excluded or limited under applicable Finnish or EU consumer law, including liability for death or personal injury caused by our negligence.

This agreement is effective from the date you first use the app and shall continue until terminated. You may terminate it at any time upon written notice to Buried Cake Games.
It will also terminate immediately if you fail to comply with any term of this agreement. Upon such termination, the licenses granted by this agreement will immediately terminate and you agree to stop all access and use of the app. The provisions that by their nature continue and survive will survive any termination of this agreement.
This agreement, and any dispute arising out of or in connection with this agreement, shall be governed by and construed in accordance with the laws of Finland.
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
